Datenschutzerklärung der App „MeinWarnSystem“

Die App "MeinWarnSystem" ermöglicht Ihnen als Nutzer, überall auf der Welt per Smartphone oder Tablet den Status Ihrer mit der Smart-Sirene verbundenen Gefahrenmelder abzufragen oder einen Probealarm auszulösen.

Diese Datenschutzerklärung klärt Nutzer über die Art, den Umfang und Zwecke der Erhebung und Verwendung personenbezogener Daten durch den verantwortlichen Anbieter dieser App auf. Die rechtlichen Grundlagen des Datenschutzes finden sich in der Datenschutzgrundverordnung (DSGVO), im Sozialgesetzbuch (SGB) und im Bundesdatenschutzgesetz (BDSG). Die Indexa GmbH erhebt und verwendet Ihre personenbezogenen Daten ausschließlich im Rahmen dieser Bestimmungen. Damit sind alle Informationen gemeint, die sich auf eine identifizierbare oder identifizierte natürliche Person beziehen.

2. Installation der App "MeinWarnSystem"
Die App "MeinWarnSystem" ist über von Dritten betriebene Vertriebsplattformen erhältlich, sogenannte App-Stores (Google Play und Apple AppStore). Ihr Download setzt gegebenenfalls eine vorherige Registrierung beim jeweiligen App-Store und die Installation der App-Store-Software voraus. Indexa GmbH hat keinen Einfluss auf die Erhebung, Verarbeitung und Nutzung von personenbezogenen Daten im Zusammenhang mit Ihrer Registrierung und der Bereitstellung von Downloads in dem jeweiligen App-Store und der App-Store-Software. Verantwortliche Stelle ist insoweit allein der Betreiber des jeweiligen App-Stores. Bitte informieren Sie sich bei Bedarf direkt bei dem jeweiligen App-Store-Anbieter.

3. Erforderliche Berechtigungen
Damit Sie die App vollumfänglich nutzen können, ist es notwendig, dass Sie den Zugriff auf bestimmte Smartphone-Funktionen und personenbezogene Daten gewähren, die auf dem Mobilgerät gespeichert werden. Die App wird Sie bei der ersten Nutzung der jeweiligen Funktion zunächst fragen, ob Sie die Berechtigungen erteilen möchten. Mit Ihrer Zustimmung greift die App auf folgende Funktionen Ihres Endgeräts zu:
• Senden von Mitteilungen, Bannern und Tönen (zur Benachrichtigung bei Gefahrenalarm)
• Standortdaten (GPS und/oder oder WLAN-basierte Standortdaten, überwiegend für die Konfiguration von WLAN-Netzwerken, SSID Suche.).
• Synchronisation von in der App generierten Daten mit der MeinWarnSystem Cloud (z.B. Aktivitäten- und Funktionsprotokoll der verbundenen Gefahrenmelder)
• Upload von Bildern oder Kamerazugriff für die Nutzung eines Konto-Avatars.

4. Widerruf der erteilten Zugriffe
Sie können bereits erteilte Zugriffsberechtigungen jederzeit widerrufen. Öffnen Sie hierzu die App-Verwaltung Ihres Smartphones/Tablets und deaktivieren Sie die bereits erteilten Zugriffsberechtigungen. Die entsprechenden App-Funktionen stehen bei nicht erteilten Zugriffsberechtigungen nicht zur Verfügung.

5. Erhebung und Speicherung von Daten durch die App
Für die Bereitstellung der App-Services ist das Anlegen eines MeinWarnSystem Accounts notwendig. Hierzu wird die E-Mail-Adresse abgefragt und gespeichert.
Die App speichert Informationen über das Endgerät auf welchem Sie die App nutzen. (z.B. Versionsnummer des Endgeräts, Geräte-ID, IP-Adresse, Endgeräte-Modell, Version des Betriebssystems und IMEI) und nutzt diese um die Bereitstellung der App-Funktionen kontinuierlich zu verbessern.
Mit erteilter Berechtigung werden außerdem das Aktivitäten- und Funktionsprotokoll in der Cloud gespeichert.

6. Datenweitergabe an die Indexa GmbH oder an Dritte
Die oben genannten Daten werden auf Servern in der EU gespeichert und sind dort ausschließlich für technische Wartungsarbeiten durch den Server-Administrator zugänglich.
Darüber hinaus erfolgt ein Datenaustausch ausschließlich zwischen den Endgeräten, d.h. zwischen Gefahrenmelder, Sirene und Smartphone bzw. Tablet.
Eine weitere Speicherung, Verarbeitung oder Auswertung von Daten durch die Indexa GmbH oder Dritte erfolgt nicht.

7. Löschung von Daten
Mit der Deinstallation der App werden auch die von der App gespeicherten Daten auf Ihrem Mobilgerät gelöscht. Für die Löschung der in der Cloud gespeicherten Daten muss der Account gelöscht werden.

8. Ihre Rechte
Ihnen stehen die folgenden Rechte zu:
a) Recht auf Auskunft (Art. 15 DSGVO)
b) Recht auf Berichtigung (Art. 16 DSGVO)
c) Recht auf Löschung (Art. 17 DSGVO)
d) Recht auf Einschränkung (Art. 18 DSGVO)
e) Recht auf Widerspruch (Art. 21 DSGVO)
Die App wird nicht für Profiling oder Scoringmaßnahmen nach Art. 22 DSGVO genutzt.

Nutzungsvereinbarung für Software und Services der App „MeinWarnSystem“

Bevor Sie die Nutzungsvereinbarung akzeptieren, lesen Sie diese bitte vollständig durch und stellen Sie sicher, dass die Nutzungsbedingungen insbes. hinsichtlich Einschränkungen und Ausnahmeregelungen verstanden wurden. Einschränkungen und Ausnahmeregelungen sind im Text hervorgehoben. Falls Sie Fragen zum Inhalt dieser Nutzungsvereinbarung haben sollten, kontaktieren Sie uns bitte unter datenschutz@indexa.de.

Die App-Funktionen stehen Ihnen erst nach Einwilligung in diese Nutzungsvereinbarung zur Verfügung. Ohne Ihre Einwilligung in die Bedingungen dieser Nutzungsvereinbarung können die App-Funktionen nicht genutzt werden. Sobald Sie Ihre Einwilligung im Zuge der Registrierung bestätigen, die Registrierung abschließen oder die App in irgendeiner Form verwenden, geben Sie Ihre Einwilligung zu den hier aufgeführten Nutzungsbedingungen.

Sollten die Nutzungsbedingungen durch den Nutzer nicht eingehalten werden, haben wir das Recht die zur Verfügung gestellten Services einseitig zu beschränken, auszusetzen oder zu beenden. Außerdem haben wir das Recht etwaige aus der Verletzung entstehende Verpflichtungen zu prüfen.

Die Nutzungsvereinbarung wird zwischen Ihnen (nachfolgend „der Nutzer“) und der Indexa GmbH (nachfolgend „der Entwickler“), geschlossen. Sie umfasst die Datenschutzerklärung und andere Inhalte, ist jedoch nicht auf diese begrenzt,. Sollte sich die Nutzungsvereinbarung zukünftig ändern, wird dies ohne weitere Hinweise durch Senden einer App-Benachrichtung angekündigt. Nach der Ankündigung tritt die aktualisierte Nutzungsvereinbarung automatisch in Kraft, ohne dass hierfür noch einmal Ihr Einverständnis abgefragt wird.
Sollten Sie den Änderungen nicht zustimmen, beenden Sie die Nutzung der App, löschen Sie Ihren Account und deinstallieren Sie die App auf Ihrem Gerät. Sollten Sie die Nutzung fortsetzen, gelten die aktualisierten Nutzungsbedingungen automatisch als angenommen und deren Einhaltung wird vorausgesetzt.

1. Begriffsbestimmungen
1.1. Die lizenzierte Software bezieht sich auf das vom Entwickler entwickelte Software-System, welches vom Nutzer heruntergeladen, installiert und auf geeigneten mobilen Geräten verwendet wird.
1.2. App-Funktionen beziehen sich auf die vom Entwickler und dessen Lieferanten über die App zur Verfügung gestellten Funktionen, welche über die lizenzierte Software auf dem mobilen Endgerät des Nutzers verwendet werden können.

2. Funktionen/Services
2.1. Der Entwickler stellt dem Nutzer Funktionen zur intelligenten Verwaltung und Überwachung der Gefahrenmelderserie 360F zur Verfügung. Mit diesen kann der Nutzer den Status verbundener Gefahrenmelder einsehen und einen Probealarm auslösen.
2.2. Funktionen können nach Einschätzung des Entwicklers oder dessen Lieferanten verändert oder optimiert werden. Die Bereitstellung von App-Funktionen kann im Zuge regelmäßiger oder unregelmäßiger Wartungsarbeiten unterbrochen sein.

3. Umfang der bereitgestellten Funktionen
3.1. Der Entwickler gewährt dem Nutzer das Recht zur Nutzung der App auf Basis der hier lizenzierten Software.
3.2. Der Verkauf, die Vergabe von Lizenzen, die Vermietung, Übermittlung, Herausgabe sowie jedwede andere kommerzielle Nutzung der App und oder deren Software ist verboten.
3.3. Die Nutzung der Software kann ausschließlich innerhalb des 360F Warnsystems erfolgen. Sollte die Software auf systemfremden Geräten installiert werden, können Hard- oder Software-Funktionen beschädigt werden.
3.4. Der Nutzer bestätigt, dass die lizenzierte Software ausschließlich für nicht-kommerzielle Zwecke verwendet wird. Falls eine kommerzielle Nutzung notwendig werden sollte, muss zuvor die schriftliche Genehmigung des Entwicklers eingeholt werden.
3.5. Der Entwickler und seine Lieferanten können App-Funktionen und Software hin und wieder ändern, updaten oder neue Funktionen und Services innerhalb der lizenzierten Software hinzufügen. Werden neue Funktionen nicht mit separaten Nutzungsvereinbarungen zur Verfügung gestellt, ist der Nutzer automatisch berechtigt diese zu nutzen und die Nutzung fällt unter die hier beschriebenen Bedingungen.
3.6. Der Nutzer ist verantwortlich für die Richtigkeit, Verlässlichkeit, Vertraulichkeit und Legalität der eingegebenen Daten und für die Legalität der Erlangung dieser Daten.
3.7. Der Nutzer wird angehalten regelmäßige Backups zu erstellen, um die Verfügbarkeit von Daten und Informationen zu gewährleisten. Der Entwickler übernimmt keine Haftung für den Verlust oder die Beschädigung von Datensätzen.
3.8. Der Nutzer wird angehalten Kontonummer und das zugehörige Passwort sicher aufzubewahren. Im Falle einer Sicherheitslücke, welche den Account des Nutzers betrifft (z.B., aber nicht ausschließlich, das Bekanntwerden des Passworts), soll der Entwickler in Kenntnis gesetzt werden und wird entsprechende Schritte einleiten. Andernfalls gehen wir davon aus, dass alle über das Konto des Nutzers ausgeführten Aktivitäten durch diesen ausgeführt oder autorisiert wurden und dieser die Verantwortung für diese trägt.

4. Dritte Parteien
4.1. Der Nutzer nimmt zur Kenntnis, dass gewisse Services des Entwicklers oder dessen Lieferanten auf Software oder Dienstleistungen dritter Parteien beruhen.
4.2. Der Nutzer nimmt zur Kenntnis, dass der Entwickler und seine Lieferanten nicht garantieren können, dass die lizenzierte Software stets die Services einer bestimmten dritten Partei umfasst und verwendet und dass diese auch in der Zukunft verwendet werden. Stattdessen ist es möglich, dass auf ähnliche Services von einer anderen dritten Partei zurück gegriffen werden kann. Sobald diese in der App/Software Anwendung finden, unterliegen sie den Bedingungen dieser Nutzungsvereinbarung.

5. Ordnungsgemäße Verwendung der Software
5.1. Der Nutzer hat die Software auf ordnungsgemäße Art und Weise zu verwenden. Die folgenden Anwendungen und Handlungsweisen entsprechen einem Vertragsbruch und sind gegen die Bedingungen dieser Vereinbarung:
a) Das Herausgeben oder Verbreiten von Computer Viren, Würmern, heimtückischer Codes oder von Schadsoftware.

b) Das Sammeln von Informationen oder Daten von Nutzern ohne deren Erlaubnis, z.B. E-Mail-Adressen u.ä.
c) Die böswillige Verwendung des Produkts auf automatisierte Weise, mit der Absicht oder dem Effekt den Server zu überlasten oder den Web-Server und Netzwerkverbindungen in anderer Weise zu stören oder zu blockieren.
d) Der Versuch unerlaubt auf Server oder Kommunikationsdaten zuzugreifen.
e) Die Produktanwendung anderer Nutzer zu stören oder zu schädigen.
5.2. Sie verstehen und willigen in Folgendes ein:
a) Es obliegt dem Entwickler einzuschätzen, ob Sie in einen oder mehrere der oben genannten Vertragsbrüche involviert sind und in Folge dessen Ihre Nutzungslizenz auszusetzen, zu terminieren oder andere Einschränkungen entsprechend der Nutzungsvereinbarung vorzunehmen.
b) Der Entwickler wird Informationen, welche durch den Nutzer unter Verwendung der lizenzierten Software erstellt wurden und welche entgegen des Gesetzes sind, die Rechte anderer verletzen oder der Nutzungsvereinbarung widersprechen, unmittelbar löschen.
c) Sollte eine dritte Partei durch vom Nutzer begangene Vertragsbrüche dieser Nutzungsvereinbarung oder durch begangene Gesetzesverstöße irgendeine Form von Schaden erleiden, trägt der Nutzer die alleinige rechtliche Verantwortung hierfür. Der Nutzer stellt den Entwickler von jedweden Ansprüchen aus von ihm begangenen Vertragsbrüchen oder Rechtsverstößen frei. Der Nutzer ist außerdem verpflichtet den Entwickler vor derartigen Ansprüchen zu schützen und für resultierende Verluste und/ oder Ausgaben zu entschädigen.
d) Sollte der Entwickler oder seine Lieferanten durch einen durch den Nutzer begangenen Vertragsbruch dieser Nutzungsvereinbarung oder durch begangene Gesetzesverstöße irgendeine Form von Schaden erleiden, hat der Nutzer die hieraus resultierenden Verluste und/ oder Ausgaben zu ersetzen.

6. Art der Informationsinhalte
6.1. Der Nutzer versichert, dass er keine Gesetzesbrüche oder unangemessene Handlungen durch die Verwendung der App- und Software-Funktionen begehen wird.
6.2. Die in 6.1 genannten Handlungen und Gesetzesbrüche umfassen, sind jedoch nicht auf diese limitiert: das Hochladen, die Übertragung oder das Teilen von Informationen mit:
a) der Verfassung oder Grundrechten widersprechenden Inhalten
b) Inhalten, welche Staatsgeheimnisse offenbaren, die Staatssicherheit gefährden, die Staatsgewalt untergraben oder die Einheit des Staates gefährden
c) Inhalten, die Hass und Diskriminierung verbreiten.
d) pornografischen Inhalten, Gewalt, Mord und Terror verherrlichenden Inhalten oder welche ein Verbrechen vorbereiten oder begünstigen könnten.
e) Inhalten, welche andere Personen beleidigen oder verunglimpfen und deren Interessen und Persönlichkeitsrechte verletzen.
f) Inhalten mit betrügerischen Absichten, welche anderen Personen Leid zufügen, diese bedrohen, belästigen, verunglimpfen, beleidigen oder deren Privatsphäre verletzen
g) moralisch verwerflichen Inhalten
h) anderen Inhalten, welche durch das Gesetz, Regulierungen, Rechtsprechung, und andere rechtliche Standards eingeschränkt oder verboten sind.

7. Datenschutz
Der Entwickler ist verantwortlich für den Schutz der persönlichen Daten der Nutzer. Für vollständige Informationen bezüglich des Datenschutzes im Zusammenhang mit der Verwendung dieser App, lesen Sie bitte die bereitgestellte Datenschutzerklärung.

8. Ausnahmeklauseln
8.1. Der Entwickler setzt alles daran im Rahmen der rechtlichen Rahmenbedingungen für die Sicherheit, Genauigkeit, Funktionsfähigkeit und Zuverlässigkeit der lizenzierten Software und verwendeter Technologien zu sorgen. Eine Garantie hierfür kann jedoch, auch aufgrund des Stands der Technik, nicht gegeben werden.
8.2. Der Entwickler übernimmt keine Verantwortung für direkte oder indirekte Verluste, welche durch höhere Gewalt oder die Fehler dritter Parteien entstehen.
8.3. Der Nutzer ist selbst verantwortlich für direkte und indirekte Schäden, welche absichtlich oder unabsichtlich entstanden sind, z.B., aber nicht ausschließlich, durch die folgenden Möglichkeiten:
a) Die Nutzung der lizenzierten Software durch Dritte und das unerlaubte Ändern der Nutzerdaten durch diese.
b) Ausgaben und Verluste, welche durch die Nutzung der Software entstehen
c) falsches Verständnis der Software
d) Andere Verluste, welche im Bezug zur lizenzierten Software stehen aber auf kein Verschulden des Entwicklers zurück zu führen sind.
8.4. Bei von der Software abgeleiteter Software, welche nicht vom Entwickler entwickelt und herausgegeben wurde oder deren Entwicklung und Herausgabe nicht vom Entwickler genehmigt wurde, handelt es sich um illegale Software. Das Herunterladen, Installieren und Nutzen solcher Software kann unvorhersehbare Risiken bergen. Der Entwickler ist frei von rechtlichen Verpflichtungen und Rechtsstreitigkeiten, welche hieraus entstehen und hat diesbezüglich das Recht, die Nutzungsberechtigung zu widerrufen und oder alle weiteren Services zu beenden.
8.5. Die Verwendung der vom Entwickler und seinen Lieferanten bereitgestellten Plattform beinhaltet Internetdienste, welche unsteten Faktoren verschiedener Art unterliegen. Der Entwickler hat hierfür Sicherheitsvorkehrungen getroffen. Es kann jedoch trotzdem zu Aussetzern, Beendigungen und Verzögerungen bei der Bereitstellung der Services kommen, welche auf Fehler des Internets (z.B. Domains), der digitalen Kommunikation oder Faktoren jenseits der Kontrolle einer der Parteien dieser Nutzungsvereinbarung zurückzuführen sind (beinhaltend, jedoch nicht auf diese begrenzt: Feuer, Überflutung, terroristische Anschläge, Epidemien, Naturkatastrophen, Aufstände, Hacker Angriffe, Schadsoftware, Netzwerkdefekte, staatliche Beschränkungen, Beschränkungen durch Internet Provider.) Der Nutzer bestätigt, dass er die vorgenannten Risiken tragen wird und dass der Entwickler für Beeinträchtigungen in der Bereitstellung der regulären Services, welche durch das Eintreten der vorgenannten Risiken hervorgerufen wurden, keine Verantwortung übernimmt.

9. Beendigung der Nutzungsvereinbarung und Vertragsbruch
9.1. Der Nutzer erklärt sich damit einverstanden, die lizenzierte Software im Rahmen der gewährten Rechte zu verwenden, das intellektuelle Eigentum des Entwicklers an der Software und deren Inhalten zu respektieren, und den in der Nutzungsvereinbarung aufgeführten Verpflichtungen bei der Nutzung der Software nachzukommen. Der Entwickler wird die Nutzungslizenz widerrufen, sollte der Nutzer gegen die Nutzungsvereinbarung verstoßen.
9.2. Bei Verstößen gegen die Nutzungsvereinbarung oder gegen Gesetze durch den Nutzer, kann der Entwickler die Nutzungslizenz einschränken, aussetzen oder terminieren oder andere Rechte und Interessen durchsetzen, welche diesem entsprechend der Nutzungsvereinbarung zustehen.
9.3. Im Falle von Verstößen gegen die Nutzungsvereinbarung oder andere mit dem Entwickler getroffene Vereinbarungen, haben der Entwickler und dessen verbundene Unternehmen das Recht, hiervon betroffene Firmen zu informieren. Die betroffenen Firmen werden bei Verstößen gegen die Nutzungsvereinbarung angehalten die Rechte und Interessen des Nutzers einzuschränken und oder Services in Teilen oder im Ganzen nicht mehr zur Verfügung zu stellen.
9.4. Die lizenzierte Software wird über Download-Plattformen bereitgestellt. Der Nutzer hat die Nutzungsbedingungen der Download-Plattform, der System Plattform sowie des mobilen Endgeräte-Herstellers zu befolgen. Sollte der Entwickler von den oben genannten Parteien in Kenntnis gesetzt werden, dass der Nutzer bei diesen gegen die Nutzungsbedingungen verstoßen hat, kann der Entwickler die Nutzungslizenz auf Anraten der genannten Parteien widerrufen.
9.5. Mit Widerruf der Nutzungslizenz ist die Nutzung der lizenzierten Software sofort zu unterlassen und alle vorhandenen Kopien der Software sind zu vernichten.
9.6. Der Nutzer trägt alle Schadensersatzansprüche, welche beim Entwickler, dessen Lieferanten oder anderen Nutzern aus Verstößen gegen die Nutzungsvereinbarung entstehen.

10. Zugrundeliegendes Recht und salvatorische Klausel
10.1. Gültigkeit, Auslegung, Änderung, Durchsetzung und Streitschlichtung der Nutzungsvereinbarung unterliegen dem Recht der Bundesrepublik Deutschland. Sollten keine entsprechenden Gesetze oder Regulierungen existieren, werden allgemeine internationale und oder branchenspezifische Handlungsgrundsätze für die Geschäftstätigkeit zugrunde gelegt.
10.2. Streitigkeiten, welche durch oder in Verbindung mit der Nutzungsvereinbarung entstehen, sollen durch den Nutzer und den Entwickler durch freundliche Diskussion beigelegt werden oder an das zuständige Gericht zur Rechtsprechung übermittelt werden.
10.3. Sollte irgendein Teil der Nutzungsvereinbarung durch das Urteil des deutschen Gerichts ungültig werden, so beeinträchtigt dies nicht die Gültigkeit anderer Vertragsbedingungen oder Teile hiervon und Nutzer wie Entwickler haben die gültigen Vertragsbedingungen einzuhalten.
10.4. Die Nutzungsvereinbarung wird im Namen des Entwickler unterschrieben.

The app „MeinWarnSystem“ enables the user to check on the status of the hazard detectors connected with the smart siren and to run test alarms using a smart phone or tablet via a WiFi or internet connection

The data protection policy shall inform the user about the type, the extent and the intention of the collection and usage of personal data, through the responsible developer of the app. The legal basis of European data protection law can be found in the General Data Protection Regulation (GDPR). Indexa GmbH uses your personal data only within the restrictions of this regulation. Personal data means all information relating to an identifiable or identified natural person.

2. Installation of the app MeinWarnSystem
The app MeinWarnSystem is being provided by sales platforms run by third parties, so called app-stores (Google Play and Apple AppStore). Your download of the app may require the prior registration with the particular app-store and the installation of the app-store software. Indexa GmbH has no influence on the collection, processing and usage of personal data in connection with the registration and the offer of downloads within the particular app-stores or the app-store-software. The responsible body is in this case the provider of the app-store. In case of need or interest, please inform yourself directly from the particular app-store-provider.

3. Needed authorizations
To be able to use the app in it's entirety, it is necessary that you authorize the access to certain smart phone functions and personal data, that are being stored on the device. The app will ask your permission upon first use of the particular function. With your consent, the app will access the following functions of your device:
• the sending of messages, banners and sounds (for notification in case of alarm)
• location data (GPS and/ or WLAN based location mainly for the configuration of wireless networks and SSID search)
• synchronization of generated data with the MeinWarnSystem cloud (e.g. activity and functional protocol of the connected hazard detectors)
• Upload images or camera access to use an account avatar.

4. Revocation of the given authorizations
You may revoke the given authorizations at any time. To do so, you should open the app-management section of your mobile device and deactivate the activated authorizations. The related app-functions will not be available without your authorization.

5. Collection and storage of data by the app
To be able to use the app-services, you will need to create a MeinWarnSystem account. This will require the registration with an e-mail account. The e-mail-address will be stored.
The app saves information about the mobile device on which you're using the app (e.g. version number of the mobile device, device-ID, IP-address, device model, version of the operation system an IMEI) and uses this information to continuously improve the app-functions. With your consent, the activity and functional protocol of your connected hazard detectors will also be stored in the cloud.

6. Data transfer to Indexa GmbH or third parties
The data mentioned above is being stored on servers within the EU and is only accessed there for technical and administrative purposes. Apart from this, data is only being transferred between the connected devices, namely hazard detector, siren and smartphone or tablet.
There will be no further storage, processing or evaluation of personal data through Indexa GmbH or third parties.

7. Deletion of data
By deleting the app, the stored data on your mobile device will also be deleted. To delete the stored data within the cloud, you will need to delete your account.

8. Your rights
You have the following rights:
a) right of access by the data subject (Art.15 GDPR)
b) right to rectification (Art. 16 GDPR)
c) right to erasure (Art. 17 GDPR)
d) right to restriction of processing (Art. 18 GDPR)
e) right to object (Art. 21 GDPR)

User agreement for: Software and services of the "MeinWarnSystem" app (called the APP or SERVICE below)

Before you accept the user agreement, please thoroughly read it and make sure that the terms of use, especially with regard to restrictions and exceptions, have been understood. Restrictions and exceptions are highlighted in the text. If you have any questions about the content of this user agreement, please contact us at datenschutz@indexa.de.

The app functions are only available to you after you have consented to this user agreement. The app functions cannot be used without your consent to the terms of this user agreement. As soon as you confirm your consent in the course of registration, complete the registration or use the app in any way, you give your consent to the terms of use listed here. If the user does not comply with the terms of use, we have the right to unilaterally restrict, suspend or terminate the services provided. We also have the right to examine any obligations arising from the breach.

The user agreement is concluded between you (hereinafter "the user") and Indexa GmbH (hereinafter "the developer"). It includes, but is not limited to, the privacy policy and other content. Should the user agreement change in the future, this will be announced without further notice by sending an app notification. After the announcement, the updated user agreement comes into force automatically without your consent being asked again. If you do not agree to the changes, stop using the app, delete your account and uninstall the app on your device. If you continue to use it, the updated terms of use are automatically accepted and compliance with them is assumed.

1. Definitions
1.1. The licensed software refers to the software system developed by the developer, which is downloaded, installed and used on suitable mobile devices by the user.
1.2. App functions refer to the functions made available by the developer and their suppliers via the app, which can be used on the user's mobile device via the licensed software.

2. Features / Services
2.1. The developer provides the user with functions for the intelligent management and monitoring of the 360F hazard detector series. With these, the user can view the status of connected hazard detectors and trigger a test alarm.
2.2. Functions can be changed or optimized according to the assessment of the developer or his supplier. The provision of app functions can be interrupted in the course of regular or irregular maintenance work.

3. Scope of the functions provided
3.1. The developer grants the user the right to use the app on the basis of the software licensed here.
3.2. The sale, granting of licenses, renting, transferring, issuing and any other commercial use of the app and or its software is prohibited.
3.3. The software can only be used within the 360F warning system. If the software is installed on non-system devices, hardware or software functions can be damaged.
3.4. The user confirms that the licensed software will only be used for non-commercial purposes. If commercial use should become necessary, the written approval of the developer must be obtained beforehand.
3.5. The developer and his suppliers can change and update app functions and software from time to time or add new functions and services within the licensed software. If new functions are not made available with separate usage agreements, the user is automatically entitled to use them and their use falls under the conditions described here.
3.6. The user is responsible for the correctness, reliability, confidentiality and legality of the data entered and for the legality of obtaining this data.
3.7. The user is encouraged to create regular backups to ensure the availability of data and information. The developer assumes no liability for loss or damage to data records.
3.8. The user is encouraged to keep the account number and the associated password safe. In the event of a security vulnerability affecting the user's account (e.g., but not exclusively, the knowledge of the password by third persons), the developer should be informed and will take appropriate steps. Otherwise, we assume that all acts performed on the user's account have been carried out or authorized by him and he is responsible for them.

4. Third parties
4.1. The user acknowledges that certain services of the developer or its suppliers are based on software or services of third parties.
4.2. The user acknowledges that the developer and his suppliers cannot guarantee that the licensed software always includes and uses the services of a specific third party and that these will also be used in the future. Instead, it is possible that similar services can be used by another third party. As soon as these are used in the app / software, they are subject to the terms of this user agreement.

5. Proper use of the software
5.1. The user must use the software in a proper manner. The following uses and practices constitute a breach of contract and are against the terms of this agreement:
a) The release or distribution of computer viruses, worms, malicious codes or malicious software.
b) The collection of information or data from users without their permission, e.g. email addresses, etc.
c) The malicious use of the product in an automated manner, with the intent or effect of overloading the server or otherwise disrupting or blocking the web server and network connections.
d) The attempt to access the server or communication data without permission.
e) The interference with or damage of the use of the product by other users.
5.2. You understand and consent to:
a) It is the responsibility of the developer to assess whether you are involved in one or more of the breaches of contract mentioned above and, as a result, to suspend or terminate your license or to make other restrictions in accordance with the user agreement.
b) The developer will immediately delete information that was created by the user using the licensed software and that is contrary to the law, violates the rights of others or contradicts the user agreement.
c) Should a third party suffer any form of damage as a result of breaches of contract in this user agreement or breaches of the law, the user bears sole legal responsibility for this. The user releases the developer from any claims arising from breaches of contract or legal violations that he has committed. The user is also obliged to protect the developer from such claims and to compensate for resulting losses and / or expenses.
d) Should the developer or his suppliers suffer any form of damage as a result of a breach of contract by the user of this user agreement or a breach of the law, the user must compensate for the resulting losses and / or expenses.

6. Type of information content
6.1. The user assures that he will not break the law or commit inappropriate actions by using the app and software functions.
6.2. The actions and violations of the law mentioned in 6.1 include, but are not limited to: the uploading, transmission or sharing of information with:
a) Content that contradicts the constitution or fundamental rights
b) Content that reveals state secrets, endangers state security, undermines state authority or endangers the unity of the state
c) Content that spreads hatred and discrimination.
d) Pornographic content, content that glorifies violence, murder and terror, or that prepares or could encourage a crime.
e) Content that offends or vilifies other people and violates their interests and personal rights.
f) Content with fraudulent intent, which harms, threatens, harasses, vilifies, insults or violates other people's privacy
g) morally reprehensible content
h) Other content that is restricted or prohibited by law, regulations, case law and other legal standards.

7. Data protection
The developer is responsible for protecting users' personal data. For complete information on data protection in connection with the use of this app, please read the privacy policy provided.

8. Exceptions
8.1. The developer makes every effort to ensure the security, accuracy, functionality and reliability of the licensed software and technologies used within the framework of the legal provisions. However, due to the state of the art, no guarantee can be given for this.
8.2. The developer assumes no responsibility for direct or indirect losses caused by force majeure or the errors of third parties.
8.3. The user is responsible for direct and indirect damage caused intentionally or unintentionally, e.g., but not exclusively, through the following possibilities:
a) The use of the licensed software by third parties and the unauthorized modification of user data by them.
b) Expenses and losses incurred through the use of the software
c) wrong understanding of the software
d) Other losses which are related to the licensed software but are not attributable to the fault of the developer.
8.4. Software derived from the software, that was not developed and published by the developer or the development and publication of which was not approved by the developer, is illegal software. Downloading, installing and using such software can involve unpredictable risks. The developer is free from legal obligations and legal disputes that arise from this and has the right to revoke the usage authorization and / or terminate all other services.
8.5. The use of the platform provided by the developer and its suppliers includes internet services that are subject to variable factors of various kinds. The developer has taken safety precautions for this. However, there may be interruptions, terminations and delays in the provision of services due to errors in the Internet (e.g. domains), digital communication or factors beyond the control of one of the parties to this user agreement (including but not limited to these : Fire, flooding, terrorist attacks, epidemics, natural disasters, riots, hacker attacks, malware, network defects, government restrictions, restrictions by Internet providers.) The user confirms that he will bear the aforementioned risks and that the developer is not responsible for impairments in the provision of the regular services caused by the occurrence of the aforementioned risks.

9. Termination of the user agreement and breach of contract
9.1. The user agrees to use the licensed software within the scope of the granted rights, to respect the intellectual property of the developer in the software and its content, and to comply with the obligations set out in the user agreement when using the software. The developer will revoke the license if the user violates the user agreement.
9.2. If the user violates the user agreement or laws, the developer can restrict, suspend or terminate the user license or enforce other rights and interests to which the user is entitled in accordance with the user agreement.
9.3. In the event of violations of the user agreement or other agreements made with the developer, the developer and its affiliated companies have the right to inform companies affected by this. In the event of violations of the user agreement, the companies concerned are urged to restrict the rights and interests of the user and / or to no longer provide services in whole or in part.
9.4. The licensed software is made available via download platforms. The user has to follow the terms of use of the download platform, the system platform and the mobile device manufacturer. If the developer is informed by the above parties that the user has violated the terms of use, the developer can revoke the license on the advice of the parties mentioned.
9.5. With the revocation of the license, the use of the licensed software must be stopped immediately and all existing copies of the software must be destroyed.
9.6. The user bears all claims for damages that arise from the developer, his suppliers or other users from violations of the user agreement.

10. Underlying Law and Severability Clause
10.1. The validity, interpretation, change, enforcement and dispute settlement of the user agreement are subject to the law of the Federal Republic of Germany. If there are no corresponding laws or regulations, general international and / or industry-specific principles of action for business activities are used.
10.2. Disputes that arise through or in connection with the user agreement should be resolved by the user and the developer through friendly discussion or submitted to the competent court for jurisdiction.
10.3. Should any part of the user agreement become invalid as a result of the judgment of the German court, this does not affect the validity of other contractual conditions or parts hereof and users as well as developers have to comply with the valid contractual conditions.
10.4. The user agreement is signed on behalf of the developer.

2. Installation de l'application MeinWarnSystem
L'application est distribuée par des plate-formes de vente, offert par des troisièmes parties, dite les app-stores (Google Play and Apple AppStore). Le téléchargement de l'application vous demandera l'inscription précédente à l'app-store et l'installation du logiciel de l'app-store. L'Indexa GmbH n’est pas responsable pour la collection, le traitement et l'utilisation des données privées en relation avec l'enregistrement et les téléchargements ou le logiciel offert par l'app-store. En l'espèce, l'organisme responsable est l'hébergeur de l'app-store. Pour les informations à ce sujet, veuillez vous informer vous-mêmes chez l'hébergeur de l'app-store concerné.

3. Besoin des autorisations
Pour la possibilité d'utiliser l'application avec tous ses fonctions, il vous faut autoriser l'accès à certains fonctions et données de votre smartphone ou tablette numérique, qui sont mémorisés sur l'appareil. L'application va vous demander la permission à la première utilisation de la fonction particulière. Avec votre permission, l'application va avoir accès aux fonctions suivantes de votre appareil:
• L'envoi de messages, bannières et sons (pour les notifications en cas d'alarme)
• les données sur la location (location à la base de GPS et/ou wifi, principalement pour la configuration des réseaux wifis et la recherche de SSID)
• la synchronisation des données générées avec la cloud MeinWarnSystem (par exemple le protocole des activités et fonctions des détecteurs de danger connectés)
• Télécharger des images ou accéder à la caméra pour utiliser un avatar de compte.

4. La révocation des autorisations données
Les autorisations données peuvent être révoquées tout le temps. Pour le faire, il vous faut ouvrir la section app-management de votre smartphone ou tablette numérique et de désactiver les autorisations activées. Les fonctions désactivées de l'application ne sont pas disponibles en ce cas.

5. La collection et la sauvegarde des données par l'application
Pour utiliser les fonctions de l'application, il vous faut créer un MeinWarnSystem compte. Cela va vous demander l'enregistrement avec un compte mail. L’adresse du compte mail est sauvegardée. L'application mémorise l'information sur le smartphone ou tablette numérique sur lequel vous utilisez l'application (par exemple le numéro de la version de l'appareil mobile, ID de l'appareil, adresse IP, modèle de l'appareil, version du système d'exploitation et IMEI) et va les utiliser pour améliorer les fonctions de l'application continûment.
Avec votre permission, le protocole des activités et des fonctions des détecteurs est aussi sauvegardé dans la cloud.

6. La transmission des données à Indexa GmbH ou troisièmes parties
Les données adressées là-dessus sont sauvegardées sur des serveurs en EU et y sont accessibles uniquement pour des opérations de maintenance par l'administrateur du serveur. En outre, les données sont seulement transférées entre les appareils connectés, vouloir dire entre détecteurs de danger, sirène et smartphone ou tablette numérique. Autres sauvegardes, traitements ou évaluations ne sont pas faites par Indexa GmbH ou des troisièmes parties.

7. La suppression des données
En effaçant l'application, vous allez aussi effacer les données sauvegardées sur votre appareil. Pour effacer les données sauvegardés dans la cloud, il faut effacer le compte.

8. Vos droits
Vous avez les droits suivants:

1. Définitions
1.1. Le logiciel sous licence fait référence au système logiciel développé par le développeur, qui est téléchargé, installé et utilisé sur des appareils mobiles appropriés par l'utilisateur.
1.2. Les fonctions de l'application font référence aux fonctions mises à disposition par le développeur et ses fournisseurs via l'application, qui peuvent être utilisées sur l'appareil mobile de l'utilisateur via le logiciel sous licence.

2. Fonctionnalités / Services
2.1. Le développeur fournit à l'utilisateur des fonctions de gestion et de surveillance intelligentes de la série d'alarme 360F. Avec ceux-ci, l'utilisateur peut afficher l'état des détecteurs de danger connectés et déclencher une alarme de test.
2.2. Les fonctions peuvent être modifiées ou optimisées en fonction de l'évaluation du développeur ou de son fournisseur. La mise à disposition des fonctions de l'application peut être interrompue au cours de travaux de maintenance réguliers ou irréguliers.

3. Étendue des fonctions fournies
3.1. Le développeur accorde à l'utilisateur le droit d'utiliser l'application sur la base du logiciel sous licence ici.
3.2. La vente, l'octroi de licences, la location, le transfert, la délivrance et toute autre utilisation commerciale de l'application et / ou de ses logiciels sont interdits.
3.3. Le logiciel ne peut être utilisé que dans le système d'alerte 360F. Si le logiciel est installé sur des périphériques non système, les fonctions matérielles ou logicielles peuvent être endommagées.
3.4. L'utilisateur confirme que le logiciel sous licence ne sera utilisé qu'à des fins non commerciales. Si une utilisation commerciale devient nécessaire, l'approbation écrite du développeur doit être obtenue au préalable.
3.5. Le développeur et ses fournisseurs peuvent modifier et mettre à jour les fonctions et les logiciels de l'application de temps à autre ou ajouter de nouvelles fonctions et services dans le logiciel sous licence. Si de nouvelles fonctions ne sont pas mises à disposition avec des accords d'utilisation séparés, l'utilisateur est automatiquement autorisé à les utiliser et leur utilisation est soumise aux conditions décrites ici.
3.6. L'utilisateur est responsable de l'exactitude, de la fiabilité, de la confidentialité et de la légalité des données saisies et de la légalité de l'obtention de ces données.
3.7. L'utilisateur est encouragé à créer des sauvegardes régulières pour assurer la disponibilité des données et des informations. Le développeur n'assume aucune responsabilité en cas de perte ou d'endommagement des enregistrements de données.
3.8. L'utilisateur est encouragé à conserver le numéro de compte et le mot de passe associé en lieu sûr. 4. Tiers

L'utilisateur reconnaît que le développeur et ses fournisseurs ne peuvent garantir que le logiciel sous licence inclut et utilise toujours les services d'un tiers spécifique et que ceux-ci seront également utilisés à l'avenir. Au lieu de cela, il est possible que des services similaires puissent être utilisés par un autre tiers. Dès qu'ils sont utilisés dans l'application / le logiciel, ils sont soumis aux conditions de cet accord d'utilisation.

5. Utilisation correcte du logiciel
5.1. L'utilisateur doit utiliser le logiciel de manière appropriée. Les utilisations et pratiques suivantes constituent une rupture de contrat et sont contraires aux termes de cet accord:
a) La diffusion ou la distribution de virus informatiques, vers, codes malveillants ou logiciels malveillants.
b) La collecte d'informations ou de données auprès des utilisateurs sans leur autorisation, par exemple les adresses e-mail, etc.
c) L'utilisation malveillante du produit de manière automatisée avec l'intention ou pour effet de surcharger le serveur ou de perturber ou de bloquer d'une autre manière le serveur Web et les connexions réseau.
d) La tentative d'accès au serveur ou aux données de communication sans autorisation.
e) Interférer avec ou endommager l'utilisation du produit par d'autres utilisateurs.
5.2. Vous comprenez et consentez à:

c) Si un tiers subit une forme de dommage à la suite de violations du contrat de cet accord d'utilisation ou de violations de la loi, l'utilisateur en est seul responsable. L'utilisateur libère le développeur de toute réclamation découlant de violations de contrat ou de violations de la loi qu'il a commises. a) Contenu qui contredit la constitution ou les droits fondamentaux

c) Contenu qui répand la haine et la discrimination.
d) Contenu pornographique, contenu qui glorifie la violence, le meurtre et la terreur, ou qui prépare ou pourrait encourager un crime.
e) Contenu qui offense ou vilipende d'autres personnes et viole leurs intérêts et droits personnels.
f) Contenu avec une intention frauduleuse, qui nuit, menace, harcèle, diffame, insulte ou viole la vie privée d'autrui
g) contenu moralement répréhensible
h) Tout autre contenu qui est restreint ou interdit par la loi, les règlements, la jurisprudence et d'autres normes juridiques.

7. Protection des données Le développeur est responsable de la protection des données personnelles des utilisateurs. Pour des informations complètes sur la protection des données dans le cadre de l'utilisation de cette application, veuillez lire la politique de confidentialité fournie.

8. Exceptions
8.1. Le développeur met tout en œuvre pour assurer la sécurité, l'exactitude, la fonctionnalité et la fiabilité des logiciels sous licence et des technologies utilisées dans le cadre du cadre légal. Cependant, en raison de l'état de la technique, aucune garantie ne peut être donnée à ce sujet.
8.2. Le développeur n'assume aucune responsabilité pour les pertes directes ou indirectes causées par la force majeure ou les erreurs de tiers.
8.3. L'utilisateur est responsable des dommages directs et indirects causés intentionnellement ou non, par exemple, mais pas exclusivement, par les possibilités suivantes:
a) L'utilisation du logiciel sous licence par des tiers et la modification non autorisée des données utilisateur par ces derniers.
b) Dépenses et pertes encourues par l'utilisation du logiciel

8.4. Les logiciels dérivés du logiciel qui n'ont pas été développés et publiés par le développeur ou dont le développement et la publication n'ont pas été approuvés par le développeur sont des logiciels illégaux. Le téléchargement, l'installation et l'utilisation de tels logiciels peuvent comporter des risques imprévisibles. Le développeur est libre des obligations légales et des litiges juridiques qui en découlent et a le droit de révoquer l'autorisation d'utilisation et / ou de résilier tous les autres services.
8.5. L'utilisation de la plate-forme fournie par le développeur et ses fournisseurs comprend des services Internet qui sont soumis à des facteurs variables de diverses natures. L'utilisateur s'engage à utiliser le logiciel sous licence dans le cadre des droits concédés, à respecter la propriété intellectuelle du développeur sur le logiciel et son contenu, et à se conformer aux obligations énoncées dans le contrat d'utilisation lors de l'utilisation du logiciel. Le développeur révoquera la licence si l'utilisateur enfreint le contrat d'utilisation.
9.2. Si l'utilisateur enfreint le contrat d'utilisation ou les lois, le développeur peut restreindre, suspendre ou résilier la licence d'utilisation ou appliquer d'autres droits et intérêts auxquels l'utilisateur a droit conformément au contrat d'utilisation.
9.3. En cas de violation du contrat d'utilisation ou d'autres accords conclus avec le développeur, le développeur et ses sociétés affiliées ont le droit d'en informer les entreprises concernées. En cas de violation du contrat d'utilisation, les entreprises concernées sont invitées à restreindre les droits et intérêts de l'utilisateur et / ou à ne plus fournir de services en tout ou en partie.
9.4. Le logiciel sous licence est mis à disposition via des plate-formes de téléchargement. L'utilisateur doit respecter les conditions d'utilisation de la plate-forme de téléchargement, de la plate-forme système et du fabricant de l'appareil mobile. Si le développeur est informé par les parties ci-dessus que l'utilisateur a violé les conditions d'utilisation, le développeur peut révoquer la licence sur les conseils des parties mentionnées.
9.5. Avec la révocation de la licence, l'utilisation du logiciel sous licence doit être arrêtée immédiatement et toutes les copies existantes du logiciel doivent être détruites.
9.6. L'utilisateur porte toutes les réclamations pour dommages qui découlent du développeur, de ses fournisseurs ou d'autres utilisateurs suite à des violations du contrat d'utilisation.

10. Loi sous-jacente et clause de divisibilité
10.1. La validité, l'interprétation, la modification, l'application et le règlement des litiges du contrat d'utilisation sont soumis au droit de la République fédérale d'Allemagne. S'il n'y a pas de lois ou de réglementations correspondantes, des principes généraux d'action internationaux et / ou spécifiques à l'industrie pour les activités commerciales sont utilisés.
10.2. Les litiges qui surviennent à travers ou en relation avec le contrat d'utilisation doivent être résolus par l'utilisateur et le développeur au moyen d'une discussion amicale ou soumis au tribunal compétent pour la juridiction.
10.3. Si une partie du contrat d'utilisation devenait invalide en raison de la décision du tribunal allemand, cela n'affecterait pas la validité d'autres conditions contractuelles ou parties. Des présentes et les utilisateurs ainsi que les développeurs doivent se conformer aux conditions contractuelles en vigueur.
10.4. Le contrat d'utilisation est signé au nom du développeur.
